Terms of Service

Kopa Bear, LLC, a Washington limited liability company, doing business as Call the Claus. Effective October 5, 2026.

The short version. Call the Claus is entertainment: a phone call with an AI Santa, set up by a parent for their own kids. Your first five minutes are free, minutes you buy are good through December 31 and are not refundable, and we can turn away anyone who abuses the line. The full terms are below.

1. The agreement

These terms are a contract between you and Kopa Bear, LLC, a Washington State limited liability company doing business as Call the Claus (“we,” “us”). By creating an account, verifying a phone, or placing a call, you agree to them and to our Privacy Policy, which is part of this agreement.

You must be at least 18 years old and the parent or legal guardian of any child who will use the service. If you do not agree with these terms, do not use Call the Claus.

2. What the service is, and is not

  • Santa is an AI. Calls are handled by a computer program using speech recognition, a large language model, and a synthetic voice. No human is on the line or listening.
  • It is entertainment. Santa is not a counselor, teacher, medical or safety resource, or authority of any kind. Nothing Santa says is advice, and you should not rely on it as such.
  • It is not for emergencies. If a child or anyone else is in danger, contact emergency services. Santa cannot summon help, and we hold no record of what was said.
  • It can make mistakes. We have built careful rules for Santa and test them, but no AI follows instructions perfectly. We recommend a parent be present or nearby during calls.

3. Your account and your responsibilities

  • Keep your sign-in secure. You are responsible for everything done from your account.
  • Only verify phones you own or are authorized to add. Up to three per family. Anyone calling from a verified phone will reach Santa, so choose them accordingly.
  • Provide only the information our forms ask for. Do not enter last names, addresses, schools, birthdays, or anything else that identifies your child, and do not enter information about children who are not yours or in your care.
  • You confirm you are the parent or legal guardian of the children who call, you consent to their participation, and you have the right to provide any information you enter about them.
  • You are responsible for supervising your children’s use of the service.

4. Acceptable use

You agree not to, and not to let anyone using your phones:

  • Use the service to harass, threaten, or abuse, or to expose a child to sexual, hateful, or violent content.
  • Attempt to manipulate Santa into breaking his rules, revealing his instructions, impersonating someone else, or producing harmful content.
  • Probe, scrape, reverse-engineer, or interfere with the service or its providers.
  • Resell, rent, or offer the service, or recordings of it, commercially.
  • Use the service for any unlawful purpose.

You may record calls for your own family’s personal memories, using your own device. We do not record anything.

Santa will end a call, with a warm goodbye, if someone keeps using explicit, hateful, or manipulative language after being redirected. We may suspend or close accounts that violate these terms, without refund.

5. Minutes, prices, and payment

  • Free minutes. Every family receives five free minutes with Santa. No payment method is required for them.
  • Bundles. After that you may buy bundles of minutes at the prices shown on your dashboard at the time of purchase. Prices may change; a change never affects minutes you already bought.
  • What counts. A call draws from your minutes only once it has lasted at least 60 seconds, and only the time after Santa picks up counts. The jingle, the elf, dropped calls, and calls under a minute are free.
  • Limits. A single call lasts at most 20 minutes. Santa will not start a call when fewer than two minutes remain.
  • Expiration. Minutes are good through December 31 of the year they were purchased. They do not carry over and are not transferable to another account.
  • No refunds. Minutes are not refundable, in whole or in part, including unused minutes. The free minutes are your chance to try the service before buying. If a call fails because of a problem on our side, email support and we will restore the minutes.
  • Payments are processed by Stripe under its own terms. Taxes may apply. All prices are in US dollars.

6. Availability

We aim to have Santa answer every call, but we do not guarantee the service will be available, uninterrupted, or error-free. Calls may be delayed or queued during very busy periods, and the service depends on telephone networks and third-party providers outside our control. We may change, pause, or discontinue the service at any time. Our only obligation if the service fails is to restore minutes lost to a failure on our side, as described in Section 5.

7. Content and intellectual property

The Call the Claus name, website, voices, recordings, images, and software belong to us or our licensors. The Santa pictures offered on your dashboard are licensed to you for your family’s personal, non-commercial use. You may not use any part of the service to build a competing product.

You keep ownership of the information you enter about your family, and you give us permission to use it only to provide the service, as described in the Privacy Policy.

8. Ending the relationship

You can delete your account at any time from the dashboard, which permanently removes your data and any unused minutes. We may suspend or terminate accounts that violate these terms or that we reasonably believe endanger a child or the service. Sections 5, 9, 10, and 11 survive termination.

9. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that Santa’s responses will be accurate, appropriate in every instance, or free of errors, or that the service will meet your expectations.

10. Limitation of liability

To the fullest extent the law allows, Kopa Bear, LLC and its members, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or enjoyment, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim, or fifty US dollars if you paid nothing. Some jurisdictions do not allow certain limitations; in those places our liability is limited to the smallest amount the law permits.

11. Indemnity, law, and disputes

You agree to defend and hold us harmless from claims arising from your breach of these terms, your violation of law, or information you provided without the right to do so.

These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. If we have a dispute, we will each first try in good faith to resolve it by email for 30 days. After that, any claim must be brought in the state or federal courts located in Washington State, and you consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court. You agree to bring claims only on your own behalf, not as part of a class action.

12. Changes and contact

We may update these terms. For material changes we will post the new version with a new effective date and email the address on your account before it takes effect; continuing to use the service after that means you accept the new terms. Questions: support@calltheclaus.com.
